I. | Purpose |
A. | establishes procedures to ensure compliance with Items 720.110 and 720.130 of the Unified Code of Corrections, Illinois Municipal Jail and Lockup Standards (November 1998). |
B. | outlines procedures for the Department Statistician when forwarding state reports to the Illinois Department of Corrections. |
II. | District Lockup Emergency Plan |
A. | a copy of the District Lockup Emergency Plan booklet is maintained within the lockup for reference by Department personnel or inspection by representatives of the Illinois Department of Corrections. |
B. | responsible unit personnel are familiar with the contents of the District Lockup Emergency Plan. |
III. | Reporting Extraordinary or Unusual Occurrences in Lockups |
A. | Illinois Department of Corrections Report of Extraordinary or Unusual Occurrence |
1. | This report will be used to report the occurrence of the following types of incidents inside Department lockups: |
a. | Death, regardless of cause; |
b. | Attempt suicide, if hospitalization or medical treatment is required; |
c. | Serious injury, defined as an injury that requires extensive medical treatment and/or hospitalization, including accidental and self-inflicted; |
d. | Escape or attempted escape; |
e. | Serious fire resulting in property damage, personal injury, or evacuation; |
f. | Detainee disturbance involving four or more individuals, riot, or hostage situation; |
g. | Battery on a staff member, visitor, or volunteer by a detainee; |
h. | Battery on a detainee by a staff member; |
i. | Battery on a detainee by another detainee if hospitalization or extensive medical treatment is required; |
j. | Sexual assault; |
k. | Occurrence of contagious or infectious disease or illness within the facility, excluding names of detainees or others involved; |
l. | Discovery of firearms or weapons, as defined in 720 ILCS 5/31A-1.1, in cells, detention rooms, or other detainee areas; |
m. | A written or verbal act of intimidation by a detainee on detainees or staff for which criminal charges result; |
n. | Use of chemical agents or Taser; |
o. | Major property damage. |
2. | This report is required by statute to be submitted to the State of Illinois Office of Jail and Detention Standards in Springfield within 72 hours of the incident or its discovery. |
3. | This report is available on the Department's intranet using "DOC 0135" for the form number or "Report of Extraordinary or Unusual Occurrence" for the form title. |
B. | Procedures and Responsibilities |
1. | When an incident described in Item III-A-1 or the discovery of previously unreported incident described in Item III-A-1 has occurred, the station supervisor of the affected district or the designated supervisor of Central Detention, as appropriate, will: |
a. | ensure immediate notification by telephone to the Crime Prevention and Information Center (CPIC) and the Civilian Office of Police Accountability (COPA). |
b. | ensure that the proper case report is submitted. |
c. | ensure that the Illinois Department of Corrections Report of Extraordinary or Unusual Occurrence (IDOC-REUO) is completed before the end of the tour of duty. Use of a Taser will be indicated by checking "Other" and specifying "Taser." |
d. | review and, if appropriate, sign the IDOC-REUO in the space provided for the "Shift Commander." |
e. | prior to the end of the shift, fax a copy of the completed IDOC-REUO to the Records Inquiry Section, Attention: Commanding Officer. |
f. | forward to the district commander or the Commanding Officer, Central Detention, as appropriate, the completed IDOC-REUO, along with all relevant reports, including but not limited to the Roster of Persons in Custody (CPD-11.515) and a copy of the Arrest Report (CPD-11.420) for all arrestees involved in the incident. |
g. | in the case of a death, provide a copy of the IDOC-REUO to the member of the Bureau of Detectives assigned to complete the federal Law Enforcement Custodial Death Report. |
2. | The district commander or the Commanding Officer, Central Detention, will: |
a. | review the completed IDOC-REUO and all accompanying reports for completeness and accuracy and indicate approval by placing their signature in the space below the "Shift Commander" approval line. |
b. | forward the completed IDOC-REUO and all pertinent reports to the responsible area deputy chief, Bureau of Patrol, as appropriate. |
c. | retain a copy of the IDOC-REUO package in the unit of occurrence in accordance with existing records-retention requirements. |
3. | The appropriate area deputy chief, Bureau of Patrol, will: |
a. | review the completed IDOC-REUO and all accompanying reports for completeness and accuracy. |
b. | upon approval, sign at the bottom of page 2. |
c. | forward to the Civilian Office of Police Accountability (COPA) a photocopy of any IDOC-REUO package concerning a death or serious injury occurring in a lockup facility. |
d. | forward the IDOC-REUO and copies of all reports and statements through the respective chain of command to the Records Division. |
4. | The detective assigned to the follow-up investigation concerning a death occurring in a lockup facility will forward a photocopy of the Supplementary Report (CPD-11.411-B) to COPA. |
5. | The immediate supervisor of the detective assigned to the follow-up investigation concerning a death occurring in a lockup facility will obtain a copy of the IDOC-REUO from the affected district station supervisor or the designated supervisor of Central Detention and follow the procedures established in the Department directive entitled "Federal Death in Custody Reporting" for the completion of the federal Law Enforcement Custodial Death Report. |
6. | The Chief Administrator, COPA, will: |
a. | ensure that a comprehensive, independent investigation is conducted by personnel of COPA of all occurrences of attempted or actual suicide or other death taking place in the lockup. |
b. | review the copies of the IDOC-REUO, reports, and statements received concerning a death or serious injury occurring in a lockup facility for completeness. |
c. | ensure that the copies of the IDOC-REUO and accompanying reports are filed and retained in COPA in accordance with existing records-retention requirements. |
7. | The Records Division will: |
a. | upon receipt of the fax from the designated supervisor of Central Detention or the district station supervisor of the involved lockup, immediately fax (with a confirmation) the completed IDOC-REUO to the Office of Jail and Detention Standards. A copy of the report will also be mailed to the address listed on the report. |
b. | file the report, the fax confirmation, and all statements and reports with the appropriate case report. |
IV. | Lockup Population Reports |
A. | obtain quarterly total lockup population information via CHRIS. |
B. | complete the Municipal Jail and Lockup Quarterly Population Report, form DOC 0131, and forward it to the Office of Jail and Detention Standards Unit. |
C. | photocopy all State of Illinois Juvenile Monitoring Information System Monthly Population Forms for Law Enforcement, Form 1149, that are received from Bureau of Patrol and: |
1. | forward the original, no later than the eighth day of the month, to Illinois Department of Corrections, Office of Jail and Detention Standards Unit. |
2. | retain photocopies of all State forms in the unit file for one year. |
