Deputy Chiefs Assigned to the Street Operations Unit

I.Purpose
This directive establishes the responsibilities of deputy chiefs assigned to the Street Operations Unit, Office of the First Deputy Superintendent.
II.Policy
The command of the Chicago Police Department is structured to ensure appropriate command response to any incident. The role of the on-duty deputy chief assigned to the Street Operations Unit, Office of the First Deputy Superintendent, is to act as the incident commander and:
  • A.respond to critical unplanned incidents where neutrality and independence are required to ensure the most appropriate and timely use of resources and to allow for independent decision making.
  • B.provide command presence and improve Department performance by ensuring appropriate action.
  • C.bring to the attention of the appropriate command staff and other supervisors both outstanding performances and observed deficiencies on the part of their subordinates in enforcing City ordinances and State statutes and conforming to the rules, regulations, directives, and policies of the Department.
III.Authority
  • A.A Street Deputy is the on-duty deputy chief assigned to the Street Operations Unit, Office of the First Deputy Superintendent, who operates with the authority of the Superintendent of Police when the Superintendent or First Deputy Superintendent is not on duty or readily available.
  • B.Unless otherwise designated by the Superintendent, the First Deputy Superintendent, or Department directive, the Street Deputy is the ranking officer on scene and has command authority to direct and utilize all resources available to all bureaus within the Department.
IV.General Information
  • A.All notifications and communications made to the Street Deputy will be made via the Crime Prevention Information Center (CPIC).
  • B.Street Deputies will be assigned seven days per week, from 1000 to 0600 hours. From 0600 to 1000 hours, the appropriate Bureau of Patrol deputy chief will assume the responsibilities of the Street Deputy.
V.Responsibilities and Procedures
  • A.The First Deputy Superintendent will ensure that:
    • 1.there is appropriate scheduling for the Street Deputies assigned to the Street Operations Unit.
    • 2.CPIC is informed of the identity of the Street Deputy.
  • B.The Street Deputy will respond and assume command of the following incidents:
    • 1.Shots fired at or by police personnel.
      EXCEPTION:
      For incidents that involve the destruction of an animal with no injury to any persons, the district executive officer (XO) will fulfill the role of the Street Deputy and respond and assume command of the investigation. If the district XO is not on duty, the district commander will fulfill the role of the Street Deputy and respond and assume command.
    • 2.Unintentional discharge of a firearm, whether on or off duty;
    • 3.Arrest of a Department member;
    • 4.Serious injury or death of an on-duty Department member;
    • 5.Suicide of an active Department member, whether on or off duty;
    • 6.Death of an arrestee while in police custody;
    • 7.Attempt suicide of an arrestee while in police custody;
    • 8.Serious injury or death of a person subsequent to interactions with a Department member, including traffic crashes and motor vehicle pursuits;
      NOTE:
      The Civilian Office of Police Accountability (COPA) will conduct law-enforcement-involved death investigations consistent with the Police and Community Relations Improvement Act (50 ILCS 727).
    • 9.Special Weapons and Tactics (SWAT) incidents;
    • 10.Newsworthy incidents;
    • 11.Other incidents that, in the judgment of the street deputy or the chain of command, require his or her command presence.
  • C.When notified of an incident that the Street Deputy would normally assume command has occurred at a location outside of the City of Chicago, the Street Deputy will determine the appropriate response protocol.
    • 1.If the incident that occurred outside the City of Chicago requires a criminal investigation, the local jurisdiction where the incident occurred will conduct the investigation. If the local jurisdiction is unable or unwilling to conduct the criminal investigation, the Street Deputy will coordinate and consult with COPA to determine appropriate investigative responsibilities.
    • 2.If the incident occurred within a reasonable distance outside of the City of Chicago and it is determined that a Street Deputy response is appropriate, the Street Deputy will respond to the scene to serve in an advisory capacity and as the Department representative to offer assistance to the local jurisdiction. The Street Deputy will:
      • a.ensure the constitutional, contractual, and administrative rights of the involved member are protected and the appropriate Department assistance and support services are offered to the member (e.g., Peer Support, EAP, providing transportation).
      • b.ensure the appropriate administrative investigation functions of the Department are completed. The Street Deputy may request the assignment of a Bureau of Internal Affairs call-out supervisor for the administration of any required chemical testing or to assist in other support functions.
      • c.ensure the appropriate reporting requirements and logistical functions of the Department are completed. The Street Deputy may request the assignment of Bureau of Detectives personnel to assist in the performance of these administrative duties and to act as a Department liaison for information exchange or assistance.
      • d. coordinate and consult with COPA when it is necessary that a criminal investigation is conducted and the local jurisdiction is unable or unwilling to conduct the investigation.
  • D.If the CLEAR system becomes unavailable, the Street Deputy will authorize the use of alternate reporting procedures, consistent with the Department directive titled "Alternate Paper Reporting Procedures."
  • E.When required, the Street Deputy will complete the appropriate portion of a Tactical Response Report (CPD-11.377), consistent with the Department directives titled "Incidents Requiring the Completion of a Tactical Response Report" and "CLEAR Automated Tactical Response Report."
  • F.The Street Deputy will perform other duties as directed by the First Deputy Superintendent or the Superintendent.
